Terms and Conditions
Effective date: 16 June 2026
These Terms and Conditions govern your access and use of the Maskani Yetu platform (the "Service"). By creating an account, browsing listings, or interacting with Maskani Yetu, you accept these terms in full. If you represent a company, you confirm you have authority to bind that entity.
1. Eligibility
You must be at least 18 years old and able to enter binding contracts under the Laws of Kenya. Licensed estate agents and developers must hold valid registration with the Estate Agents Registration Board (EARB) or relevant county regulatory body.
2. Account obligations
- Provide accurate and verifiable information during registration and when publishing listings.
- Safeguard your login credentials and notify us immediately if you suspect unauthorised access.
- Accept responsibility for all activity conducted through your account.
3. Listing standards
- Only advertise properties you are legally mandated to sell, rent, or manage.
- Ensure descriptions, pricing, room counts, availability dates, and photography are truthful and up to date.
- Do not upload offensive, defamatory, or discriminatory content.
- We reserve the right to review, edit, or remove listings that violate policy or Kenyan law.
4. Fees and payments
Some features (premium placement, marketing boosts, data exports) may attract subscription or transactional fees. All fees are quoted in Kenyan Shillings (KES) and are exclusive of applicable taxes. Invoices must be settled within the stated payment terms.
5. Prohibited activities
- Scraping, copying, or redistributing content without prior written consent.
- Misrepresenting ownership, titles, or approvals for developments.
- Soliciting users outside the platform using spam, phishing, or deceptive practices.
- Introducing malware, attempting to breach platform security, or tampering with analytics identifiers.
6. Intellectual property
All trademarks, logos, software, and platform content remain the property of Maskani Yetu or our licensors. Limited usage rights are granted for the purpose of marketing listed properties while you maintain an active account.
7. Liability
We provide the Service on an "as is" and "as available" basis. To the maximum extent allowed by law, we exclude liability for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our aggregate liability will not exceed the total fees paid by you in the three (3) months preceding the claim.
8. Indemnity
You agree to indemnify and hold harmless Maskani Yetu, its directors, and staff against any claims, losses, or costs arising from breach of these terms, infringement of third-party rights, or violation of law.
9. Suspension or termination
We may suspend or terminate accounts that breach this agreement, engage in fraud, abuse platform tools, or damage other users' experience. Upon termination, you must cease using our content and delete any confidential information obtained through the Service.
10. Governing law and dispute resolution
This agreement is governed by the Laws of Kenya. Disputes should first be addressed amicably with our support team. If unresolved within 30 days, parties agree to submit to mediation under the Chartered Institute of Arbitrators (Kenya Branch) before pursuing court action. The courts of Kenya have exclusive jurisdiction.
11. Changes to the terms
We may update these Terms to reflect new features, regulatory changes, or best practices. We will post the effective date and notify registered users of material updates. Continued use after changes constitutes acceptance.
